Scope of Services
The scope of the services offered by Trinity Voyages includes the preparation and filling of applications for business visitor visas, temporary work and residency permit, entry clearance and entry visas. Trinity Voyages agree to provide services to Client including any of its affiliates of person such as any parent corporation, subsidiary, partnership or commonly held entity. The Client will ensure that Trinity Voyages is provided all necessary information and inputs required for each assignee on case-to-case basis.
Once the client has assigned the case, Trinity Voyages will provide the necessary documentation viz-a-viz document checklist to obtain the appropriate immigration authorization. If required, Trinity Voyages will, with prior intimation to Client, connect with its network of affiliated immigration lawyers and partners globally for the completion of the assignment. Rights and obligations in respect to this Agreement shall be between Client and Trinity Voyages. Trinity Voyages shall be responsible and liable to Client in relation to all services provided to Client under this Agreement.
Trinity Voyages will perform the services in a highly professional manner in accordance with the industry standards and requirements of the Client and assure that the service charges are competitive with the charges for similar services offered by its competitors.
Please Note: The immigration rules and regulations of every country are under government judicial system and may change depending on various political factors. This may or may not result in delays in the processing of visas, which are beyond the control of Trinity Voyages.
Client Responsibilities
The Client will provide clear communication authorizing the following:
Authorization to request and gather all applicable information to Trinity Voyages which will be required to manage, coordinate, as well as prepare and submit the appropriate visa application to local immigration authorities, for an applicant and eligible accompanying family members.
The Client will also provide Trinity Voyages with all of the necessary information on the employee, compensation, family, destination, legal entities, and other related details needed to initiate a visa application process. This data will be confidentially maintained by Trinity Voyages, including but not limited to, any of the technology networks maintained by Trinity Voyages. Furthermore, it will not be shared with any party who is not directly involved in the processing of the case. (i.e., Trinity Voyages network, government labor office, translation vendor)
Billing Policy
The parties agree that in general the charges include professional fees for the services as detailed, filling and actual expenditure incurred in disbursement of the documents. Trinity Voyages shall ensure that the service charges are competitive with the charges for similar services offered by the competitors.
Trinity Voyages shall bill the Client on a “per service request” basis and only on completion of every such service request. Completion of service implies that the case has been submitted to the appropriate labour authority.
If Trinity Voyages is requested by the Client to perform any other services, such as Apostille of documents, translation of documents, notarization of documents or legalization of vital records, then Trinity Voyages shall provide a detailed estimate of the expenses and obtain prior approval from the Client for such expenses.
Client understands that Trinity Voyages has made no guarantees relative to the outcome of the above-described matters. Client agrees that Trinity Voyages fees are related to the time, effort and skill that will apply to the above-described matters.
In the event that a case is cancelled, after which Trinity Voyages has provided Client with the necessary document checklist and any applicable forms/templates, a 50% cancellation fee will be charged to the client.
Invoicing and Payment Policy
When Trinity Voyages is requested to perform certain casework, an invoice will be created and issued to the Client. Payment for an invoice is due within 15 days of the invoice date. All invoices are due within 15 days of the invoice date. Any undisputed invoice, that remains unpaid for 30 days, even after giving a written notice to Client, will be submitted to a collections agency. As may be allowed by law, Trinity Voyages may cease working on a specific case or client request if client, in accordance with this Engagement Agreement, does not make payment.
Trinity Voyages accepts payment in the form of cash, cheque, cashier cheques and bank wires. Payment instructions are provided on the actual invoice. In the event that a check is returned for non-sufficient funds, Client will be charged for any bank fees incurred.
Confidentiality
Without prejudice to the generality of the Terms and Conditions, as enclosed herewith, Trinity Voyages agrees to keep confidential at all times any information in any form (regardless whether oral, writer, digital, physical, express or implied) in relation to the business, structure, operations, financial information, offices, employees, customers or clients(including potential customers and clients) of Client, including any materials prepared by Trinity Voyages for Client in connection with services, irrespective of such information being labelled or identified as “confidential” or “secret” which is or will come into the possession or knowledge of Trinity Voyages during the course of providing services under this Agreement shall be deemed to be ‘Confidential Information’ of Client.
Trinity Voyages agrees that all Confidential Information shall be sole and exclusive property of the Client. Upon the termination of this Agreement or upon Client’s request Trinity Voyages shall (i) immediately cease to use the Client’s confidential information, (ii) within ten (10) days of the termination return to the Client or destroy such confidential information and all copies thereof.
Termination
Client may terminate this Agreement at any time, with or without cause, by providing 30 days written notice to Trinity Voyages. Termination does not affect Client’s responsibility for payment charges due up to the date of termination.
Governing Law
This Agreement shall be governed by and construed in all respects in accordance with the substantive law of India without regard to the conflict of laws.
Arbitration and Conciliation Act
Any disputes in connection with or arising out of this agreement shall be submitted to one impartial arbitrator. The provisions contained in the Arbitration and Conciliation Act, 1996 of India, shall govern the arbitrator. The venue of arbitration shall be Pune. The language of the arbitration shall be English. The fees of arbitration will be borne equally by both parties. All disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts situated in Pune.
E-Visa
- Visa fee is subject to change, it will be notified at the time Application lodged.
- Visa may be delay in case of technical error and Rush in immigration or Embassy.
- Visa may be refused/delayed if your details not matched with the documents.
- Valid E Visas does not guarantee to allow crossing at immigration checkpoints. Immigration will verify the details before grating you permission.
- Visa may be denied if you have previous valid visa, deported or overstay
- Visa will be Valid for selected entry point/airport while filling an application.
- If there is any mistake in the information provided by applicant, we'll not be responsible for visa rejection or incorrect visa.
- Working days considered excluding weekend & public holidays. It can be extended as per embassy or immigration decision.
- We reserve the rights to deny processing of any application.
- Visa will not be processed until the payment reflects at our end.
- There is no point of contact in Immigration to expedite your visa process as the whole procedure is online.
Visa
- TRINITY VOYAGES has no role in the decision making process for granting the visa and no promises have been made by any of the staff of TRINITY VOYAGES for the same.
- The Embassy/ High Commission/ Emigration Consulate General reserves the right to ask for further Documentation.
- Issuing of visa depends on the sole discretion of the visa officer and TRINITY VOYAGES shall only act as a representative on behalf of Customer. Visa officer may or may not approve the application. Customer shall not at any point of time have the right to claim on TRINITY VOYAGES for such rejection or delayed in approval of application by the visa officer.
- TRINITY VOYAGES shall not be liable for any failure or delay in performance of its respective obligations, if that is caused by force majeure, viz., fog, earthquake, floods, fire, riots, strike, acts of terrorism or circumstances beyond control of TRINITY VOYAGES.
- TRINITY VOYAGES is not liable for any delay in processing or the decision once the visa application is submitted. And in case of a delay I agree to reschedule my travel accordingly.
- Visa application fees is non Refundable and is payable even if a visa is not granted.
- As per the guideline of Embassy/ High Commission/ Emigration Consulate, an applicant cannot overstay. In case of overstay, he/she shall be responsible for all the legal obligations and consequences occurs on time to time (Including overstay penalty).
Air Ticketing
- Please check whether your passport is valid as per your travel date
- Flight Schedule may be changed as per Airlines Policy.
- The above fares are as of now and are based on slab of 01 full paying Adult travelling together so if the number changes, the costing shall vary.
- We are not holding any confirmations for the same as of now.
- We give air ticketing services to our clients. Clients booking flights with us have to ensure on the off chance that he requires a transit visa. In the event if asked we can help with transit visa.
- The fares are subject to change depending on the class availability or subject to change depending upon the tax increment while issuing the ticket or the day we issue your ticket.
- In order to go ahead with the Air tickets the passport has to be valid for minimum 6 months from the date of return.
- For ticket blocking we shall require first and last pages of the passport & as well as you obtain a valid visa copy, after verification of the same we will be able to provide you the blocked PNR details with the PNR time limit.
- Once the ticket is issued any later amendments, Changes, Cancellations etc. shall be chargeable as per Airlines policy.
- Please advice your meal, seat & frequent flyer no. so that we can update in the PNR.
- For any changes, amendments, cancellations & no show, you need to let us know 48 hours prior to flight scheduled departure.
Travel Insurance
- Trinity Voyages is only accountable for issuing the Travel Insurance policy as per the choice of the traveler.
- TRINITY VOYAGES Visas does not assume any part in settlement of the claims.
- Any claims by the travelers regarding the Travel Insurance policy shall be handled solely by the Insurance Company.
